1. Agreement to Terms

By accessing or using SPiGAME's website and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Services.

These Terms constitute a legally binding agreement between you and SPiGAME.

2. Eligibility

You must be at least 13 years old to use our Services. If you are under 18, you must have parental or guardian consent. By using our Services, you represent that you meet these requirements.

3. Account Registration

To access certain features, you may need to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password
  • Notify us immediately of any unauthorised access
  • Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Use of Services

4.1 Permitted Use

You may use our Services for lawful purposes only, in accordance with these Terms.

5. Online Store and Purchases

We strive to provide accurate product descriptions and pricing. However, we do not warrant that product information is error-free. We reserve the right to correct errors and update information without notice.

5.2 Pricing and Payment

  • All prices are in GBP (£) and include VAT where applicable
  • Payment is processed securely through Stripe
  • We accept major credit and debit cards
  • Payment must be received before order fulfilment

5.3 Order Acceptance

Your order constitutes an offer to purchase. We reserve the right to accept or reject any order for any reason, including:

  • Product unavailability
  • Pricing errors
  • Suspected fraud
  • Violation of these Terms

5.4 Delivery

Physical products are fulfilled by our print-on-demand partner (Printful). Delivery times vary by location. We are not responsible for delays caused by shipping carriers or customs.

5.5 Returns and Refunds

Under the UK Consumer Contracts Regulations, you have the right to cancel your order within 14 days of receipt. To request a return:

  • Contact us at support@spigame.com
  • Products must be unused and in original condition
  • Return shipping costs are your responsibility unless the product is faulty
  • Refunds will be processed within 14 days of receiving the returned item

Custom/personalised items may not be eligible for returns unless faulty.

5.6 Faulty Products

If you receive a faulty or damaged product, contact us within 30 days. We will provide a replacement or full refund at no additional cost.

6. Intellectual Property

6.1 Our Content

All content on our Services (text, graphics, logos, images, software) is owned by SPiGAME or our licensors and protected by UK and international copyright, trademark, and other intellectual property laws.

6.2 Limited Licence

We grant you a limited, non-exclusive, non-transferable licence to access and use our Services for personal, non-commercial purposes. This licence does not include:

  • Reproduction, distribution, or modification of content
  • Commercial use without written permission
  • Removal of copyright or proprietary notices

6.3 User Content

By submitting content (feedback, reviews, posts), you grant us a worldwide, royalty-free, perpetual licence to use, reproduce, modify, and display such content in connection with our Services.

7. Third-Party Services

Our Services may contain links to third-party websites or integrate third-party services (Stripe, Printful). We are not responsible for:

  • The content or practices of third-party sites
  • Third-party terms of service or privacy policies
  • Transactions with third parties

8. Disclaimers and Limitation of Liability

8.1 "As Is" Basis

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Uninterrupted or error-free operation

8.2 Limitation of Liability

To the maximum extent permitted by law, SPiGAME shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or goodwill
  • Service interruptions or errors
  • Third-party actions or content

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or £100, whichever is greater.

8.3 UK Consumer Rights

Nothing in these Terms affects your statutory rights under UK consumer protection law, including the Consumer Rights Act 2015.

9. Indemnification

You agree to indemnify and hold harmless SPiGAME, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any third-party rights

10. Termination

We may suspend or terminate your access to our Services at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Extended periods of inactivity
  • Any other reason at our discretion

Upon termination, your right to use our Services ceases immediately.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you may also have the right to bring proceedings in the courts of your country of residence.

12. Dispute Resolution

We encourage you to contact us first to resolve any disputes informally. If unresolved, you may pursue:

  • Alternative Dispute Resolution (ADR)
  • Online Dispute Resolution (ODR) via the EU platform (if applicable)
  • Court proceedings

14. Severability

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and SPiGAME regarding use of our Services.
